regarldess of him having a "Bi-Polar" disorder only a few cases are violent, Bi-Polar isn't a violent disorder its an emotional disorder dealing with mostly mood swings. the issue of violence is particularly perplexing in connection with the role of psychiatric disorders as contributing factors.

i understand how him being bi-polar can affect his judgements.. but like i said before i seriously doubt his disorder was that extreme. he wasnt going to no special school his dumbass was goin to continuation school (behavorial purposes) becuase he fights too much. to me he simply seems like a bully and how the word bi-polar disorder came to light was for his defense in the case.

he was a bad ass kid who got embarassed the bus driver break checked him in front of people so he tried to justify his gangster in front of his friends by gettin off on the bus driver.

but then again.. thats just how i see it

To answer your question; they should be treated the same way, unless they have proven that they cannot control their actions, then they should be treated in a harsher way.

Like this kid as an example - after his 2nd or 3rd attack he should have been removed from the population. The fact this was his 7th or 8th attack is ridiculous.

If you are a threat to others, you shouldn't be around others.
That is just like me saying to you "You annoy me on siccness, and you do it repeatedly so therefore you shouldn't have internet access anymore"

You know your logic is failing, but you pride yourself on it too much to say so.

i'm an advocate for a civil society where that lady doesn't have to worry about shit like that happening to them for no apparent reason.

and if it does happen, there is no excuse for it. there shouldn't be. SOME PEOPLE ARE JUST FUCKING NUTS.

people like you and i shouldn't be put in danger because of the new age notion that having a behavioral disorders excuses an offender's violent behavior. fuck that. i stand for accountability.

and if the person does have a disorder, then maybe they can get help in the clink.

if that lady was my (or your) family member, how much would we care that the offender was bi-polar? not me.

like i said, these labels excuse and validating a person's violent behavior.

i worked in the group home system for four and a half years. i've already dealt with people that fall into this category of behavior, and worse. let them get the help they need. but in the meantime, isolate them the fuck away from the society that i live in.

you want these people to walk the streets with our mothers, sisters, etc after watching that video? lol

You have done a great job of explaining why this situation may have happened as a result of his bi-polar disorder, and I do in fact have a pretty decent knowledge on the disorder.

However, that doesn't change my opinion on what should have been done in the situation.

As I have stated in the "cop punches girl" and "sex offender" threads, I firmly believe in the principle that;

If you do X you get Y - regardless of race, sex, mental disorder, wealth, etc

This kid should be punished in the exact same way as anyone and everyone else.
yes that does make sense, but what you fail to realize is that "x" was never done in dudes eyes, only yours.
yes, x is relative according to intent and the various circumstances that constitute that action being played out.

i know you are interested in enquiring into subjectivity but in this case you fail to see the subjectiveness thats of your own making.

tell me, if two people seem to do the same action while coming from completely differing intent, are they really doing the same action or are they just fulfilling their intent?

maybe the system should have put in place of the bus driver, a paraprofessional that specializes in special education on the "short bus"

no clue what kind of abuse the guy went through but there are better ways to ask a mentally unstable person to sit down and the failure here is on the system for not installing a person of authority who obviously only knows how to drive a bus and not much more.
notice how she didnt get hit till she called for cops.
obviously the system needs to make a better way to handle such situations.
Maybe they could install a bus driver that specializes in special education like i said, maybe the system can have a a special ed person on the bus, maybe they could have had a silent button she could have pressed, maybe a bodyguard.
punishing the guy who obviously is unstable will only ensure that he will react like his aggressors as that happens even in so-called stable folks.
