One determines if it's a "hate crime" based on the motive. If you did it to steal money, it's just a regular crime. If your motive was that you hated blacks and the main reason you attacked him was because of his race, then it would be a "hate crime." Just like any other crime, if there is no evidence to support the racist motives, then it cannot be considered a "hate crime." So simply hurting someone from a different race does not constitute a "hate crime." And I'm not agreeing or disagreeing with your view of "hate crimes" I'm just explaining them.
