Eight guilty of hate crime in Long Beach beating

A judge today found that nine of 10 youths had joined in beating three white women in Long Beach on Halloween night, ending a racially charged trial muddled with conflicting testimony and allegations of witness intimidation.
The youngest defendant, a 12-year-old girl, was, in effect, acquitted of any involvement in what Judge Gibson Lee ruled was a hate crime by eight of the teenagers. The ruling was handed down by Lee because juvenile courts do not have juries.
The minors could face sentences ranging from probation to being sent to a county youth camp when the punishment is handed down.
"There are no winners today," said Brian Shern, supervising attorney for the district attorney's Juvenile Court operations in Long Beach. "I feel sorry for the victims."
The holiday incident, on a well-to-do street in Bixby Knolls, has roiled the racially mixed port city of nearly half a million people.
Ten black youths, ages 12 to 18, were accused of assault with intent to cause great bodily harm in the attack on the three white women.
Eight of those face a hate crime sentencing enhancement after Lee agreed with the prosecution's claim that the youths, none with a criminal record, besieged the young women out of racial hatred.
The assault left Loren Hyman, 21, with multiple fractures in her nose and around her eye. She will require surgery to re-position her eye.
Her friend, Laura Schneider, 19, was knocked unconscious and likely suffered a concussion. There was no testimony that the third woman, Michelle Smith, 19, suffered significant injuries.
The defendants' families accused investigators of grabbing the wrong youths in a rush to judgment to quell neighborhood alarm.
The media and the district attorney's office have blown the incident "out of proportion," Larry Austin, 53, a friend of some of the defendants' families, said earlier today.

The reward money offered for information leading to the arrest and conviction of the killers has reached $105,000.
The shooting happened near Central Avenue and 49th Street on Friday afternoon, when two gunmen got out of a vehicle and began firing at the victims.
David Marcial, 10; his 22-year-old uncle, Larry Marcial and a 17-year-old neighbor named Luis Cervantes were all killed in the shooting. A fourth victim, 12-year-old Sergio Marcial Jr; was critically wounded.
Fearing retaliation, police would not reveal where Marcial was being treated.
The gunmen are believed to be African-American and according to police, the motive may have been racial hatred or mistaken identity.

Kaitlyn Avila died Oct. 1 when two men pulled up in front of her family's apartment and one shot her point blank.
"This wasn't an accident or case of her getting caught in the fire," police Deputy Chief Charles Beck said Monday. "He intended to kill her. This was a callous killing. It is beyond even what gangsters consider usual."
Beck said the killer approached Kaitlyn, father Cesar Avila and her 6-year-old sister as they were getting out of their car after a trip to McDonald's. He wounded Cesar Avila, erroneously believing that he was a member of a rival gang, then shot Kaitlyn once in the chest, police said.
A joint task force of the LAPD and FBI has arrested one suspect, the alleged driver. But the 17-year-old suspected triggerman, Jonathan Banks, was still being sought.
