Beware of These Speeding Ticket Myths

While your best defense is to ensure you're always driving below the speed limit, most of us don't.

Nevertheless, if you've received a speeding ticket, you should consider fighting it instead of simply prepaying and skipping the court date. A speeding ticket may fine you $50 (or over $300 in some areas), but the cost to you expands greatly if your car insurance rates jump.

Like anything else, you have to be proven guilty and the government (i.e. the police) have to prove that you actually violated the law. So, why not make the government do its job?

If you're going to fight a ticket, don't believe everything you read. I've listed some common myths that I hope to clear up:

  • The officer won't show up
    Many people think police officers rarely come to court. Thus, they think that you just have to show up in court to beat your ticket.

    Wrong. Part of a police officer's job is to testify in court about the citations they write. If they regularly didn't come to court, they would be in trouble. Everyone would just be able to skate on their traffic tickets.

    Out of all the traffic cases I've seen, only a few were dismissed because the officer didn't show up. It's a rare occurrence. The officer needs to be present at your trial to testify about what you did wrong, but you can't bank on him not showing up. You need a better plan.
  • You can go with the flow of traffic
    Traffic court judges have heard lots of excuses. But one that will never get you anywhere is "I was just going with the flow of traffic."

    As a driver, you're obligated to follow the speed limit. If you are clocked speeding by a police officer, you can present defenses in court. But it's not a defense to say that you were going at the same pace as other cars on the road.

    Think about it: If someone is on trial for murder, they wouldn't argue "I only killed the person because other people were doing it." Adults are responsible for their own actions, and doing what the crowd is doing doesn't constitute a legal defense.
  • You can easily argue radar technicalities
    If you were clocked by a radar gun, you'll probably read about the possible sources of interference and errors associated with these devices. But you can't just go into court and allege that the officer's radar gun didn't work.

    There are certain defenses you can raise regarding the government's speed measuring device. But you have to present evidence that proves your defense. As a layperson, you can't just go into court, talk about radar technology, and allege that the officer's radar gun was inaccurate due to interference or frequency problems. I've seen defendants do this, and the judge almost laughs them out of the courtroom.

    What you can do is to ask the officer for his calibration records. In most jurisdictions, the police have to periodically have their equipment checked for accuracy. If they fail to do this, it could get your ticket dismissed.
The moral of this story is not to believe all of the common wisdom about tickets. They can be beatable, but only if you know what you're doing and have the time to do the research.

The best way to get out of a speeding ticket is to contest the ticket by mail. The officer wont get paid for testifying in court because he has to respond my mail as well. The chance is slimmer for the cop to respond by mail. Also if youre still found guilty youre eligible for a time extension and a retrial, which can be delayed as much as 3 months (if i remember right). So months and months later the cop is again required to return another letter, chances are he wont care/remember what happened/or just forget to write the letter, which is equivelent to not showing up in court. Do it by mail, I know a few people that have gotten out of tickets that way.

I've actually been told by several CHP officers that if you go with the flow of traffic or go less than 10% over the speed limit then you're probably fine. It's the officer's discretion though so if you're breaking the law, you're breaking the law. Either way, I don't go above 75 and I usually stay around 70 or a little higher.

sheriffs in az get breaded for givin tickets so they some ticket giving whores. I got one a few months back. didn't bother apologizing his ass was gonna give it to me regardless.
I was polite and didnt raise a stink like most assholes.
I went to class and learned how to be more cautious. cuzz that's all u can really do

I speed all the time. I've had 3 speeding tickets, 2 of them cost over $250. I still speed, why you ask? Because I don't really give a fuck about a speeding ticket.

if u wanna take it to trial then thats ur right but if u lose the case (which most people do) u have to pay the whole fine.then i dont know if some countys charge u for court fees................unless u know for sure u will win its not worth it..............most judges will drop ur ticket amount down anyway..........



if ur gonna risk paying the whole ticket (if u take it to trial) u might as well pay the whole ticket at the gate and just do traffic school.at least u wont get a point and end up paying more money for insurance..............that point is expensive...........

I've gotten 3 speeding tickets before. As pissed as I get, I'm always polite, hoping the guy goes easy on me. I was never charged for nor had 2 of those 3 tickets on my record.
I never paid the one I did get, though. Been five years since. Does it get more expensive as time passes, like interest or something?

I just went to court and paid one on Friday. I have not had one in years....but got caught in a speed trap last month. Actually, the judge was cool.....The ticket should have been $170....but since I had a good driving record he only charged me $100 with 3 months supervision and the ticket is droped.

You have to pay court fees even if you don't take it to court.

I'm 4 out of 5 on officers not showing up to court. Only one that showed up was a city cop and it was for rolling through a stop sign. 3 speeding tickets and one red light ticket got dropped because the cop never showed up.

I never had to deal with points til I moved to florida, in some ways it makes me wanna move back home. But here's a tip for people its illegal to shoot radar in the rain. But the cop clock me doing 56 and drop it to 50 which was cool cause it would of been another 100. Now I'm in the middle of fighting a no seat belt. Seriously who gives a fuck if I'm not wearing it I'm over 21, not like I'm endangering someone else. My head smack the windshield when I was wearing 1, if I'm gonna die from an accident, I rather just not wear 1 then.
