anybody been in a personal injury lawsuit????

two years ago, i was riding to so cal with a female friend of mine when she lost control of her car and it flipped a couple times. my hand pretty much went through the passenger window, and all the skin on the middle part of my right middle finger got ripped off, you could see the bone/tendon. i was treated at the local ER, got one stitch (cuz there wasn't much skin left to stitch), and i went on my way. they said it might take a year or two to heal, but it's been that long and my finger is still fucked up. visually, it's hella scarred and my middle knuckle looks fat as hell...plus, i cant bend or straighten it all the way, it gives me minor pain, and it's significantly weaker than my other fingers now.

farmer's insurance just offered me like $5,500 as a settlement, but they haven't seen any of my medical records, and they don't know that it's still bothering me and hasn't fully healed.

what route should i go??

i'm not accepting that first offer, but should i get a personal injury lawyer, or just give them all the info myself, and see what their next offer is??? i have no experience with personal injury lawyers or anything, but i'm sure some of you do...


what should i do??? how much money can i expect?

i used to be a claims adjuster for GEICO..
here is the protocol for a Bodily injury case...
they ain't supposed to offer a settlement until they receive all you medical bills. the ball is in your court. either you take the settlement, or get a lawyer to negotiate a higher settlement.

same shit with me, not no skin pulled off damn cant imagine but i bent the fuck out of it and the shit still hurts after about almost a year, the being weaker than ya other fingers/hand shut sucks i notice it but will still put hands on someone lol

the driver is insured by farmer's, and since the accident was her fault, farmer's is covering it...it's not MY insurance company. the only thing they are basing this first settlement off of is my medical bills, and i think maybe an extra 1000 for pain and suffering...

Hold off and keep on rejecting their offers. Then tell them that your going to get a laywer and then they'll probably make you another offer. If you think its fair then take that or go to court. If you go to court, find a lawyer that will accept a percentage of the settlement. They'll want like 30%-40% but that way none of the money comes from your pocket.


I was in a car accient acouple years ago that wasnt my fault. I tore my chest muscle and it took me about a year to recover from everything. I just waited cuz the insurance company was trying to give me like 8 gs. I ended up getting 60% of 90,000........

Yea I had to have 2 surgeries from the accident. Since I had surgery my chest will only recover to like 90% so i got permanent damage. I still cant fully use it the same as the other. It was rough but recieving a check for 56,000 was worth it........

hmmmmmmmmmmm....ima definately push that route...i gotta go release my medical records tomorrow, take pics of my hand, then i'll be talking to farmer's...thanks folks...keep the advice coming.
