I listed Cheeky Blakk's "Let Me Get That Outcha" CD on eBay. The producer of one of the tracks e-mails me regarding the cd. Here's the e-mail I got from her:

"Im the publisher of Cheeky Blakk Let me get that outcha and Id like to speak with about selling this CD. I can be reached at 504-201-7544 All Hood Music Publishing Ms. G. Robert"

So then I responded:
"What's going on and how can I assist you in regards to the Cheeky Blakk CD??"

Then she replies with this e-mail:
"I can be reached at 504-201-7544. As I mentioned before, I am the publisher of this song. Which means I and only give permission for this song to be sold. I have never signed any contracts with you and you are selling my song. Thats what's going on and this is only the beginning."

Is it me or is this one dumbass producer that don't know shit about property rights?! I don't think I am doing anything wrong since I am selling an original CD and not no MP3 or CDR. If what I am doing is wrong then should all record stores that sell used cds have permission to sell any artists' album?? I'm sorry, but I truly feel that this person is an idiot for even trying to e-mail me about it.

yeah, that cd was somehow paid for already, so she can already have made the money off of it. its not like u stole it from her and paid for it, im assuming. once the copies are pressed and shipped out, its no longer her problem, but thats just my opinion, i could be wrong.

St. Charles tried to pull the same shit on me a few years back on some SMG originals.

Once you purchase the CD, you have the right to do with it what you please, you take ownership of that copy.

Here's the definition of copyright infringement.
Copyright infringement is the unauthorized use of copyrighted material in a manner that violates one of the copyright owner's exclusive rights, such as the right to reproduce or perform the copyrighted work, or to make derivative works that build upon it.

You are not reproducing the item, or performing it, you are selling it in a marketplace in its original form.

Hit her with info on the First Sale Doctrine and you should be left alone.

lol, the bitch is dumb. just for that I hope you get hella bread for it, then I would email her a copy of the final sale and rub it the fuck in. there is absolutely NOTHING wrong with what you are doing. first of all no lawyer would be dumb enough to even try to take it to court, but if she does find one that dumb, the judge would just laugh in his face. like the other dude said, once you buy the album, you can do anything you please just as it doesnt involve reproducing it in any way

IF ITS THE ORIGINAL CD, SHE CAN EAT YOUR ASS WITH A SPOON. AINT NO DIFFERENCE WITH DOING THAT & GOING INTO A USED CD SHOP & SLANGING IT.

"First off, I don't understand what exactly you are trying to do?!? You're saying that I don't have permission to sell your song?! Just so you know I am not selling your song but the entire Cheeky Blakk CD. Are you trying to tell me that I am violating your property rights?! What property rights are bing violated?? I am selling an original CD and not an MP3 or a CDR that was purchased at a record store. Do you see other artists and producers e-mailing eBay members seeking some sort of compensation for selling a CD of theirs on eBay?? Approaching me with such threat of not signing any contracts with you to sell "your song" is an invalid argument. Do you think the RIAA will consider this a violation of property rights?? I'm sorry but its far from any type of violations. So do you think that all record stores selling all artists' albums without their knowledge is committing a crime?? Again, that is not the case and far from it. Sorry, but I don't know why you would even e-mail and tell me all of this. If you have a problem with me selling a cd that contains a song of yours then I suggest you should take that up with eBay. I am sure they will tell you that I am not in violation."

Here's her latest e-mail response:
"If a record store sells a cd, yes they have permission (cosignment deal, distribution deal, etc.) I know what you're doing and yes you are violating. You are selling Cheeky Blakk CD that she created for profit and she hasn't recieved a dime yet Now if you truly think you aren't violating then we'll see in court."
