8 years for tagging is ridiculous. $7000 worth of damage? Wesley snipes had 1 million in back taxes and they gave him 2 years. we live in a f'd up society.

2yrs in jail+$7,000 in fines+1-2yrs of community service..

I THINK THAT CHILD MOLESTERS NEED TO BE PUBLICLY DISEMBOWELED WITH A RUSTY FISH HOOK IN MY OPINION.AS FAR AS THIS POOR KID GETTING REAL TIME HE AINT GOING TO DO NOTHING BUT LEARN HOW TO BE A BETTER CRIMINAL. OUR CROOKED LAW ENFORCEMENT OFFICIALS EVERYTHING FROM OFFICERS TO JUDGES MUST BE OUT OF TOUCH GIVING A KID 8 YEARS FOR TAGGING WHILE SOME ASSHOLE WITH A LAWYER THAT HAS A JUDGE FOR A FRIEND CAN WALK SCOTT FREE AFTER BURNING DOWN BUILDINGS OR RAPING SOME OLD LADY. IS THERE ANY LOGIC IN LAYING DOWN THE LAW???

February 07, 2007 12:00 AMSTOCKTON - A man described as one of the most prolific graffiti vandals in the city was sentenced Tuesday to state prison, an almost unprecedented penalty that prosecutors hope serves as an example to other taggers.

Nicholas Hernandez, 21, who sprayed walls all over the city under the pseudonym "Meat," pleaded guilty to felony vandalism in January.

Under a judge's sentence, he will spend 90 days in the custody of the California Department of Corrections and Rehabilitation before returning to serve the remainder of his yearlong sentence at the San Joaquin County Jail.

In addition to his prison term, Hernandez will pay $9,000 in restitution to Caltrans and a other $2,000 to a south Stockton business he vandalized. Further damages owed to the city have not yet been calculated.

San Joaquin County Deputy District Attorney Janet Smith said she knew of no other case in which a convicted tagger was sent to prison. Smith said that to some extent, Hernandez is being used as an example to other vandals.

"He is a part of why people do not feel comfortable in this city and why we can't get business in this city," she said. "They are making us look like a citywide ghetto."

Hernandez is likely to spend his state prison term at the Deuel Vocational Institution in Tracy, Smith said.

Who still tags in 2010/2011?

I say let the property owners put on some brass knuckles and have at the kid...I'm all for taking responsibility for your actions, but I dont want to see some petty "criminal" go to jail/prison over some BS....leave that space for the senseless murderers and child molesters, etc...

I am willing to bet that the reasoning most people who still tag has NOTHING to do with wanting to contribute to or spread hip hop culture....

At least where I grew up, it was never on some hip hop s--t...

Thats crazy.. I know some foos that did prolly the same amount of damage in taggin if not more ... And got like 1000 hours of community service.

Damn that judge is a real cunt, tryin to be some judge judy shit. I can understand being punished for being caught but this is too extreme.

Writers shouldve went out and bomb the city in one night.

that bitch just wanted to make an example out of him.....lesson learned? no...he'll serve his time come out as a hardened criminal and spend the rest of his life in and out the system...8 years no parole seems a bit extreme for an estimated 7000 in damage....give him 1 year and hella fines and community service

michael vick gets 23 months in prison for dog fighting...

and im sure there are others ( murderers, rapists ) that walk after getting off on some good behavior....



edit: when i would tag way back in the early 90's until about 2002...it was never in the name of hip hop....for me, it started as gangster shit and then evolved into an art form which i learned looks equally as cool on a piece of paper....the worst part was spending time on a piece making it real cool and then seeing promptly removed by the city...yet the ones where you just tag something hella fast and moved on stayed around for years
