WRONG! That's probably the biggest misconception there is regarding mixtapes. It is NOT legal the make someone else's music available for mass consumption without the owners consent. It is NOT legal to reproduce copywritten material without the owners consent, regardless of the form (compact discs, mp3's, etc). It does NOT matter whether you profit from it or not. And for the record "profit" doesn't just mean money, it means ANY type of gain or return.

Mixtapes are NOT legal when the material on them isn't properly licensed and no amount of bullshit excuses will change that fact. The reason nobody is bending over backwards to sue all these mixtape DJ's is simply because it would cost more in legal fee's and prosecution expenses than they could ever get back. There's only a small handful of mixtape DJ's who make any real money putting them out and it's no coincidence that EVERY SINGLE ONE OF THEM has their paperwork in order.
