Neighborhood Alert: 'Gangbuster Bill'

The 109th Congress, has passed House of Representatives (H.R) 1279 an act to amend title 18 of the United States Code, to reduce violent gang crime and protect law-abiding citizens and communities from violent criminals. The "Gangbuster Bill" provides 10 years for acts of violence, 20 years for serious assult, 30 years for kidnapping and life for some juveniles.

The short title of this new federal law is the "Gang Deterrence and Community Protection Act of 2005" and its implications may have a profound, impact on our communities and the individuals who proudly display their gang affiliation and, more imprortantly continue to participate in violent gang crimes.

The Law provides for reforms to existing criminal laws that enhance penalties to deter and punish illegal street gang activity and related criminal law reforms. For example, if one commits, conspires, threatens or attempts to commit, a gang crime they shall be subject to a fine and if the gang crime results in the death of any person, they shall be sentenced to death or life in prison.

Further "if the gang crime is kidnapping, aggravated sexual abuse, or maiming, be imprisoned for life or any term of years not less than 30; if the gang crime is assault resulting in serious bodily injury, be imprisoned for the life or any term of the years not less than 20; abd un any other case, be imprisoned for life or for any term of years not less than 10;

Congresswoman Maxine Waters who voted against this legilation, stated. "This measure is an attempt to federalize a list of crimesthat are already addressed under state jurisdiction. It will penalize non-violent drug dealers and it is a political move to make one who can look the strongest on law and who can make the other side appear to be weak."

HR 1279 was crafted to take jurisdictional power from the state legislators and place it under federal jurisdiction. It expands the definition of criminal street gangs, includes language about juvenile prosecution, expands mandatory minimum sentences and imposes the death penalty for certain convictions. The initiative included several elements that were particular troubling to Congresswoman Waters.

"If a teenager who is not affiliated with a gang, for example, is observed by law inforcement talking to a known gang member, "she explained, "he or she may be unjustly identified with that gang and subject to any related charges."

She pointed out the condition that confronts many of the youngpeople who happen to live in a neighborhood that is rife with gang activity. A walk to school, store, or friends home are likely to find them in some contact with a 'gang member' and ultimatley subject to guilt by casual association.

The Law provides for the trial of juveniles as adults without any review of individual circumstances. It also provides for mandatory minimum sentences for some offenses effectively eliminating any discretion udges may have in the review of mitigating circumstances and subsequent punishment and it expands the federal death penalty for certain cases.

Attached to HR 1279 was an amendment offered by Congresswoman Diane E, Watson that increases the number of federal agents dedicated to battling gang violence. The Watson amendment adds 100 new inspectors and 100 new agents to the Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE) The inspectors and agents will be assigned to new high intensity interstate gang activity areas, as outlined in the legislation.

An Additional amendment offered by Watson, and approved by the House, requires the Attorney General to seek input from local elected officials before designing an area as a high-intensity interstate gang activity area.
