The 109th Congress, has passed House of Representatives (H.R) 1279 an act to amend title 18 of the United States Code, to reduce violent gang crime and protect law-abiding citizens and communities from violent criminals. The "Gangbuster Bill" provides 10 years for acts of violence, 20 years for serious assult, 30 years for kidnapping and life for some juveniles.
The short title of this new federal law is the "Gang Deterrence and Community Protection Act of 2005" and its implications may have a profound, impact on our communities and the individuals who proudly display their gang affiliation and, more imprortantly continue to participate in violent gang crimes.
The Law provides for reforms to existing criminal laws that enhance penalties to deter and punish illegal street gang activity and related criminal law reforms. For example, if one commits, conspires, threatens or attempts to commit, a gang crime they shall be subject to a fine and if the gang crime results in the death of any person, they shall be sentenced to death or life in prison.
Further "if the gang crime is kidnapping, aggravated sexual abuse, or maiming, be imprisoned for life or any term of years not less than 30; if the gang crime is assault resulting in serious bodily injury, be imprisoned for the life or any term of the years not less than 20; abd un any other case, be imprisoned for life or for any term of years not less than 10;
