SAN DIEGO -- Reality-show host Tila Tequila is suing ex-boyfriend Chargers linebacker Shawne Merriman.
The lawsuit alleges assault, battery, false imprisonment and emotional distress in connection with an alleged domestic violence incident between the couple in September.
The suit does not specify damages.
Merriman was arrested early Sept. 6 after Tila Nguyen, aka Tila Tequila accused him of choking and throwing 'like a rah doll' her while she was at the San Diego Chargers player's Poway home.
She also told deputies she had been restrained as she tried to leave the player's home.
Authorities said the pair had been at a local nightclub until about 1 a.m. and that alcohol was involved in the incident.
A sheriff's spokeswoman told reporters, more specifically, that Nguyen had been drinking.
Tequila signed a citizen's arrest warrant accusing Merriman of battery and false imprisonment.
Merriman and his attorney insist that Nguyen was drunk, and that Chargers linebacker was trying to protect her.
"I think when it all surfaces, it will be a different situation. Period," Merriman said describing Nguyen as an acquaintance.
Nguyen fired back saying, "I am allergic to alcohol. It has been publicly known for years. That is how I got the name Tila 'Tequila' cuz the irony. I can't drink."
The District Attorney's Office decided not to file charges against Merriman in the alleged incident.
