Yes but the Judge can overturn it and change sentencing if there is Probable cause. They are veryy slow to do so or just refuse to until some OUTSTANDING amount of Evidnese is produced.
You see I could kill Ms Jones and get found Guilty. I could then pay some one with my Record sales money to say they did. Think I could get out that easy? :dead:
1st You would still have to show evidence PERIOD!
2nd The reason the judges look down on it is cause they will have a harder case the second time around, The witnesses tend to Die or be forgetful and the sentencing outcome most likely wont be as much as Raided.
And It has happened before In the California Penal System that a person was found guilty and another person later confessed to the crime and it still took years to get that origally convicted person released.

Nah I haven't......in the army now and have been since 1994 and I moved around the world basically so many time cant keep still and then recently a year ago moved back to home Vallejo and still in the army recruiting!
