Initiative 901: Smoking ban sails to victory

Soon, smokers will be asking for more than a light.

They're also going to need a tape measure.

A proposal to ban smoking inside public places and workplaces sailed to victory last night as expected despite a controversial rule that forbids lighting up within 25 feet of doors, windows and vents. Passers-by are exempted.

The win for Initiative 901 gives Washington the nation's strictest statewide smoking ban, barring smoking in places such as bars, restaurants, clubs, bowling alleys and non-tribal casinos. The measure takes effect in 30 days.

"We are proud, happy and delighted," said Michael Sullivan, spokesman for the American Cancer Society, a sponsor of the measure. "People ... stood up and said we believe this is the right thing to do. We know the health impact of secondhand smoke and we're proud to stand along (with) others who are trying to protect their community."

Dave Wilkinson, a security worker at a Renton bowling alley who led the minimal opposition to the initiative, said he wasn't surprised by the outcome.

"It kind of comes back to the fact that we just didn't have the money to get out and inform the voters," Wilkinson said.

A loud cheer rose from the crowd when the first election results came in at Kells Irish Restaurant & Pub in Seattle, where supporters of the measure celebrated a substantial early lead that held throughout the night.

Meanwhile, just outside the door, Anne Smith, 29, and her stepsister, Mary Swanson, 26, were puffing hungrily.



Nevertheless, they said they support the ban. "I do think it should pass -- as a smoker," said Swanson. "I smoked 10 years, I quit, and when I started again, it was in a bar."

She admitted, however, to a hankering for what will soon be the good old days. "I'd like there to be two or three underground places where I could still smoke."

"It's called your house or your car," interjected Smith, who had no idea she'd walked into the pro-law rally, as she put it.

"Maybe I'll quit with the law," Smith added. "That'd be a good thing."

Unlike Washington's measure, most other statewide bans exempt some businesses, such as bars, private clubs, card rooms and cigar lounges. And no state has a deeper no-smoking buffer than Washington's proposed 25-foot rule. (Some cities do.)

Under the ban, Washington businesses can seek waivers from the 25-foot buffer if they can show that smoke wouldn't infiltrate the business.

The ban will not apply to tribal lands, including casinos.

The measure authorizes local health departments to enforce the ban on businesses with fines or license restrictions.

Roger Valdez, manager of the Tobacco Prevention Program for Public Health -- Seattle & King County, said officials are more interested in clearing the air than handing out fines.

"Our plans are really education, education, education and then enforcement," Valdez said.

Local law enforcement agencies will be responsible for enforcing the initiative against individuals, with violators subject to a $100 fine.

The proposal was largely sponsored by health care interests. The American Cancer Society contributed $521,000 of the campaign's $1.38 million.

Wilkinson and his allies raised a little more than $12,000, largely from bars and non-tribal casinos

They're seriously banning smoking in bars? Our state has officially become home to a bunch of fucking pussies. Is there gonna be a list of places that smoking is banned in or are these places just going to do it individually? And 25 feet? That's pretty significant and I really don't think that the smoke would interfere even at 10 feet, if the restaurant/bar/whatever didn't have shitty ventilation.

All tribal casinos are still fair ground becuase they are privately owned by the tribe...

So then every single restaurant, bar, and club is now non-smoking? To me, that's really fucking stupid. I understand some people don't like cigarette smoke, but I don't particularly like smelling some mother fuckers exhaust when they drive by or are parked at a light in front of me. It's the same thing to me, if you don't like cigarette smoke and want to go to a bar w/out it, open your own fucking bar and stop bitching about what people want to do. That's why most places have smoking sections (retaurants at least) in the first place. I really think this is pretty pathetic that it passed, cause a non-smoker doesn't have the right to tell someone who does smoke that they can't smoke somewhere. I really think it should be left up to each business to decide if they are will allow smoking or not...Obviously non-smokers would win the vote, cause the majority of people dont' smoke. That's just ridiculous.

The reason I oppose this initiative is because it gives the POLICE too much indiscriminate power... ''Um well you see judge, I stopped them b/c they were smokin' a cigarett, but I found this work on 'em too"

I curious to see the proportions of racial discrimination among who is cited.

There is 30 days until this becomes law.

Big Brother is coming and watching.

From my understanding, and correct me if I'm wrong, but from how I interpret 901 in the voters pamphlet, it states the only safe places to smoke are in your house, at a park, or if you are walking down the street (i.e. you can't loiter and smoke w/in 25 ft of vents, windows, and doors) if you are not staionary you can smoke.

I am not a smoker (of cigarettes) and I agree there should be a ban, but this is way over the limit on personal freedom in my opinion.

Plus, we all know that Bud smoke is bottom priorty in the city of seattle, I am interested to see if cigarettes will recieve a harsher penalty then some bud smoke...

I'm also pissed about the repeal of the gas tax and monorail, ah well, at least we avoided all the B.S. tort reform....

The monorail is a huge dissappointment, this comes as a detriment to everybody in Seattle and the city itself. Transportation and education are clearly the Puget Sounds biggest economic problems.....

I'm not trippin, I don't smoke cigarettes...But I'll keep that in mind when I do...$100 is a little excessive though. I just don't get why they're trippin about cigarettes and 2nd hand smoke when they should be worryin about the shit load of cars that drive every day and fuck up the ozone, or what's left of it. Cigarettes should be the least of people's worries.

Idaho is always behind as many know.. "the 'no smoking' in any establishment that serves food until after 4pm" law was passed a year or two back.. I was just in Oakland and you cant smoke ANYWHERE indoors .. I was in the club like WTF..?

.. I need to quit amoking anyway.. *sigh*

if you don't like car exhaust, build your own highway and only allow yourself to drive on it.

I think the whole 25 foot thing is way overboard, but I do not oppose a smoking ban in bars and restaurants. Sure some of them have non-smoking sections but its not even a separate room, so what good does that really do. I just don't like going out at night and coming home reaking of smoke. Then again I usually get so drunk that I won't notice the smell until the next morning haha.

It's about time. Smoking is a disgusting filthy habit and smokers know it. It will kill you, and it will kill the people around you. Fuck the dumb shit, I can't welcome this with more of an open heart. I can finally go out, hit the bars, and not develop allergies. Why should other people suffer because of someone elses bad habit? Bars are for drinking, you wanna smoke, goto a hukka bar or however it's called. Freal, good news.

You guys wanna bitch about something, bitch about our city being the #1 cost of living in the nation... that's something that actually affects us. Smokers will get used to being outside to smoke, but we're all fucked with this cost of living bullshit. I'm SERIOUSLY considering moving to arizona or another cheap state and telecommuting with the pay of Seattle, or New York because of this.
