Twelve-year-old girl accused of fatally shooting her mother over being grounded

Monday, October 11, 2004

(10-11) 03:54 PDT DALLAS (AP) --

A 12-year-old girl upset about being grounded by her mother fatally shot the woman in the face while she slept, police said.

Elvira Marion Walton, 48, was discovered in her bed early Sunday by her son. The 10-year-old boy called police around 1 a.m.

"Apparently the motive is because the daughter was upset that the mother disciplined her," police Sgt. Gary Kirkpatrick said in Monday editions of The Dallas Morning News.

The girl has been charged with murder. Police found a gun in the house, but investigators did not immediately say whether it was the weapon used in the shooting or who owned it.

An older daughter, Thanica Derrick, said her mother had been having trouble with the girl. Walton had six children and lived in a converted garage used as the family home.

"She is your average 12-year-old, hormones and everything," said Derrick, 22. "There's nothing that bad to make her do that to my mama. She had been breaking out of the house and not going to school."

-That's one fucked up little girl.

The only one home was the mom (asleep). Apparently, the daughter who shot her brought some friends over to watch her own mom breathe her last breath.

DALLAS -- A Dallas child remains in the juvenile dention center, charged with killing her mother. The girl was detained Sunday, after it was discovered her 48-year-old mother was shot in her sleep.

"We know she had been upset with her mother because she had recently grounded her, but certainly not something that people would believe she would kill her mother over," Dallas police Sgt. Gary Kirkpatrick said.

The 12-year-old told investigators an intruder shot her mother in the head.

Before police were called though, the girl invited friends over to witness the 48-year-old woman lying in bed gasping for breath. Today the landlord cleaned the small garage home on Colonial Drive and neighbors began looking back on the family relationship.

"It looked like they got along, but it looked like they didn't want to mind, you know how little girls can be. It looked like she didn't want to mind," neighbor La Shonda Washington said.

The junior high student will remain at the juvenile detention facility charged with murder. Her next hearing could determine a possible punishment if and when the case goes to trial. That hearing is set for October 21.
