Thats stupid :confused:

I don't see why you would ever plead guilty to a DUI.

With any halfway decent lawyer (Tatupu could obviously afford top of the line here) you almost automatically get a deal for reckless if not negligent.

Whats the point of hiring a lawyer to try and fight it when he took a breathalizer test and had a result doubling .08?

Pretty much.

For the most part, it seems Lofa is a stand up dude, and he is bascially owning up to what he did. I read that he said for the judge not to give him special treatment because of who he is. I dont know if that is true or not, but it fits his persona.

You must have never gotten a DUI or known anyone who has.


Its almost automatic that they reduced the charges to Reckless. There are millions of random arguements that lawyers can use:

-Have you ever heard about the "Highp Protein Diet Defense" in DUI cases? Something tells me Lofa eats a high protein diet.

-Do you ever get heart burn? Well my expert witness will testify in court that heart burn can ruin any breath test results.

-Are you on any prescription meds?

-Did you burp 15 minutes before you blew?

-Did you have gum in your mouth?



and all that is not even getting into the meat of the arguements.


-Did the cop follow procedure when he pulled you over?

-Did the cop even have a right to pull you over?

-Was the breathalyzer calibrated properly? (big problem here in WA)

-Did you understand your rights at the time?

-Did you talk to a lawyer before you blew?

-Was the cop in his jurisdiction?

-How long did the cop follow you before he pulled you over



I can go on for days. A good lawyer could make a good case out of any ONE of those questions. I have never heard of anyone with a lawyer ever getting more than a reckless, and I would say more than 40% get off with NOTHING.... regardless of if they blew a .09 or .25.

My associate just got pulled over for his 3rd DUI in less than 2 years. Guess what happened when he got a good lawyer......DROPPED
