that whole process it way 2 complicated. But i never drank and drive again tho, that shit works, 3 mos of alchohol classes set my ass str8, i take a cab everywhere.

I don't like driving drunk, but I'm more confident in my own driving then other peoples.....plus I know for a fact that I can drive better drunk than my potna who never drinks drives when he's sober.....that foo is a hot ass mess when he drives

You can see what deal they offer you before getting an attorney. It don't matter what the first officer considered, you were over the legal limit and that is what will be on trial, not the fact a police officer was considering alternatives. That's a moot point.
Expect DUI Classes ( Estimating 1500-2000)
A fine ( Estimating 1500-2000)
A short suspension of your license of 30-180 days; fees to pay the DMV a restricted license ( allows to drive to and from work only) estimated 100; fees to the DMV when it's time to upgrade back to unrestricted license status estimated 100.
Insurance rates increase. Having to keep an SR22 on file with the DMV; it proves you are maintaining insurance. If you stop paying insurance at any time, even if your car is not running your license is immediately revoked.
The conviction will stay on your record at least 7 years although I've heard some argue about 10; 7 0r 10 not sure.

DUI laws are changing rapidly out here in California. I think some of you are going off of past run in's and it's all good, but some county's don't play the okie dokie shit when it comes to that. It's a very serious charge. On top of that, don't ignore what he said...

so i got my first DUI, was pulled over for turning into the wrong lane
It shows that even if he blew a .13 which may not seem as much to some of you, but it's clear his judgement affected by the amount of alcohol he consumed.

One other piece of advice I can give you is, seek where you can attened AA Classes and register before the court orders you too. This will show the court you are serious about cleaning up your act.

This may be old news, or it may have changed, but...

4 mistaminers on the same charge (in other words, you keep fucking up on the same thing).

Adds up to one felony and can be sent to prison. Now, before anybody jumps the gun and tries to say that's incorrect. I saw plenty of those cases first hand everytime I was incarcerated. Last time was in 2000.

I also heard they can tack on a shit load of years on court probation which is not a real biggie, but just keep your ducks in a row Homie. Because they could throw that back at ya if you go to court for a speeding ticket or lesser charge (any run in with the law).

Remember though, everybody in here is from a different county, so what worked for them / us may not work for you. I'm not tryin' to scare you Homie, just being real that's all.

The one thing we can all agree is, be prepared to pay HUGE FINES.

I get a lawyer for traffic tickets

Its helped keep shit off my record and keep me out of jail
You talking an actual "Lawyer", or a "Public Defender?"

I just had to ask because some people think a "Public Defender" is a lawyer, but he just happens to be in training to become a lawyer. Almost same diffrence.

just be happy you arent in arizona where they have a manditory 10 day jail sentence and interlock device for a year for your first one.

Aint no lawyer getting you out of a dui and blowing .13, take the plead and do ya probation.

My brother got a 2nd dui and that's when it gets more serious and you do weekends in jail

no. i dont care to get anyone fired. im just trying to get as easy a punishment possible. i think that fact could possible help my case. or at least a good lawyer can possibly make it help my case
Drunk drivers word < Lying pig. Get a lawyer so you wont have to say "i wish i had got a lawyer" I almost took a 3 month plea bargin, but last minute my lawyer told me we'd go to trial and i'd only pay if i won. And i only got a msd 500$ charge instead of 2 felonies..

But in your situation your lawyer would basically be threatening trail to get a better deal, I wouldnt take a dui to trial if they have the breathalizer. If you hadnt blown and refused to test... maybe then you would have a chance at trial. Talk to a lawyer thats the first step to deciding if you need one.

i blew .16 when i got my 1st and last DUI...

I didn't get a lawyer...pleaded no contest..paid the fines...went to DUI school..and that's it...good thing i got mines before 2006 lol...cuz from 2006 and up..it stays on your DMV record for 10 years..

You will just get a diversion.....you should be in and out of court in 15 min max. No need for forkin out 800+ on a lazy lawer. Been there and done that bullshit...

No, some people are career public defenders. It's a low job, but some people never leave it, and some enjoy helping out people in need. If it were lawyers in training it would be a bunch of 20 something year old white kids doing the job, not a bunch of miserable middle-aged people.

Get some quotes, weigh your options. Nobody is going to make false promises to you, so I say sit down with a professional for a half hour, discuss shit with him and tell him to level with you. If he thinks you won't get off on anything he won't waste his time unless he's desperate. But there's no reason not to accept the free help of a public defender; sure he might not be a high-powered shark but he has a ton of experience with incidents like yours and more legal knowledge than you to boot. Can't really go wrong.

I see what your saying and it makes sence. I actually learned something new today (for real).

I just personally don't like the system as a whole (like many people, I'm sure). I've had my share of public defenders and the whole process of going through court etc etc...

At one point, I had this asshole (public defender), call me up a week before court and ask if I was ready to pay (the court) $300.00. I told him yeah...soooooo this muthaphucka calls again the morning I'm getting ready for court and ask if I had $700.00. I was like WTF?!?!?! He proceeds to tell me that I must pay the court $700.00 and still serve jail time and to be prepared for a hefty sentence.

I was like, "Fuck you muthaphucka and fuck the court!"

Needless to say I was picked up on that warrant and went to jail hahahaha!!!!

BUT! When I went to court in my jumpsuit and shackles...the D.A. (that had been following me throughout my case) didn't show up for court and sent a substitue. The bitch didn't know what she was doing and threw her hands up while the judge yelled at her to get her shit together.

After facing 6 months to a year in county jail. Since the substitue D.A. couldn't bring an arguement..the judge gave me 3 weeks of jail time! Hahahaha!!!! the Homies I was shackled up with and I were laughing all the back to the jail. My case was the talk of the day in jail.

I got out, never paid them fuckers a dime and I was cleared!
