So the accident I got in last year in December, i was going into the left turn lane and this guy cut me off hit the passenger side and from the impact I went across the center median and an oncoming car swerved to avoid hitting me but still got clipped in the back. I have a scratch on the bumper and a small little bend in my rim on the right side and the drivers side front fender is a little banged up and some scratches but still drivable. Now my insurance told me by mail after investigating its not my fault, since I have liability insurance only and to hit up State Farm (the guy who hit me's insurance) so I called my insurance and they told me to take the guy to small claims court.
Now State Farm sent me a letter saying it's my fault, that their insured driver legally went into the lane while I "went through the center median" to get to the turning lane.... both claims denied from my insurance and his, I havent heard shit from the guy's insurance that I hit after I was hit.. so is small claims the way to go? or am I pretty much fucked and stuck fixing my own car? This dude hit me but it seems like my lazy ass insurance company aint gonna do shit for me and i'm gonna end up having to pay out for both cars..
