I wasn't sure who to ask about this so I figured you might know...

Suppose I were to have a sound clip from a movie in one of my songs (let's say a 5 sec. clip at the beginning), would I have to purchase the rights to have it in there or can I just put it in?

For example: Say I want to put a sound clip from the movie "New Jack City" where Nino Brown (Westly Snipes) says "Am I my brother's keeper?" What do I have to do to have the rights to get that in my song?

Well....besides the fact that shit has been used about 200 times on other people's shit......yeah you would need permission to use it. And most likely it's not gonna be worth it. That's IF they let you use it......because they can tell you NO.

But.....the bright side of it is.......if it's just going to be some underground album then you really don't have much to worry about. You're a little fish with not much money......you wouldn't even be worth goin' after really.

Example: The THX Deep Note from the beginning of movies that Dr. Dre used on the Chronic 2001 album that he got sued for.......Luni Coleone used it too on his album. But who's the one who got sued for it? Dre......because he got hella money!

Dre won his case by the way and proved that he re-made that shit himself.

Thanks for answerin, I knew I could count on you.

I wasn't saying I wanted to use that exact clip, just showin an example. Just curious if they charge you to use it, you have to have permission or if you can use it freely. Thanks for the info.

One more question about it though...how do you get permission for it? Who would you have to contact?

Ummm.......normally you would need to contact the copyright holder (the movie company)......but most people go through the Harry Fox Agency to get licenses to use samples. I'm not too sure if they license movies.....but I know they do music......I don't see why not though. You can look into it further here...... http://www.nmpa.org/hfa.html

Anytime.....and I mean anytime and anything you sample without permission is considered copyright infringement. It doesn't matter what it is or where you got it from. And it can get you in alot of trouble.....so you want to be careful. Also....don't believe the "if you use less than 4 seconds it's cool" lie. That's total bullshit.....you can sample .002 seconds of something and get sued for it......so sample with care.
