Oakland officer shoots 15-year-old suspected drug dealer

OAKLAND - A 15-year-old suspected narcotics dealer who had discarded a pistol while being chased by police was shot and critically wounded Tuesday night by an officer who thought he was reaching for another gun, investigators said.
But on Wednesday, investigators said no second gun had been found on the youth, who remained in critical but stable condition at a local hospital Wednesday night. Police said they did not learn his age until several hours after the shooting.

The mother of the 15-year-old, who did not want her name or her son's name used, is a single parent who lives in West Oakland. "I'm angry, I'm upset, I'm confused," she said. "I just don't understand how he ended up in East Oakland to even be a part of what happened.

"And I'm angry about the situation in general," she said. "I understand why police have to defend themselves if they think a person has a weapon. But I don't understand why the officer fired if he knew (her son) had dropped the gun."

The incident began about 8:15 p.m. Tuesday when Officer Alan Leal and his partner, whose name was not released, were on patrol in the area of 106th Avenue and E Street. They saw a young man at the intersection who they thought was trying to conceal narcotics in his mouth and decided to detain him, investigators said.

Instead, the suspect began running through backyards toward 107th Avenue with Leal's partner chasing him, while Leal went to 107th to try to head him off, police said.

During the foot chase the youth dropped a loaded .32 pistol, Lt. Ersie Joyner III said. The officer in pursuit recovered the gun and broadcast on his portable radio that he had the weapon and that the suspect was still fleeing, police said.
As the youth arrived in the 900 block of 107th Avenue, Leal ordered him several times to stop and surrender, but he refused, Joyner said. When Leal thought he was reaching for something in his waist band, he shot him once in the front of the head from a distance of about 40 feet, investigators said.

"The officer said he thought the suspect was trying to arm himself and that is why he shot him," Joyner said.

Besides no second gun being found, police said the youth also had no narcotics in his mouth. But investigators said he may have swallowed them, spit them out during the foot chase or lost them from his mouth when he was shot.

Joyner said it is not uncommon for suspects to have more than one gun and officers are aware of that. Just last week a murder suspect being chased by police dropped one gun while being pursued, and when officers caught up to him, he tried to pull another gun, Joyner said.

Leal - who has not been involved in other shootings - and his partner were placed on administrative leave, a routine procedure in such cases. The shooting is being investigated by the homicide unit, which handles all police involved shootings, and the Internal Affairs Division.

The youth's mother said she had last spoken with her son Tuesday evening, about buying some shoes. She didn't hear from him again, and was not informed about the incident until late Wednesday morning when one of her son's friends told her about it. Authorities had not been readily able to identify him because the youth was not carrying any identification when he was shot.

yo man hope he pulls through and god gives him a second opportunity in life....But I think yall should be posting vids and even pics of him in that condition cause that is some personal ish and should be kept in the midst of family and friends...anyway hope for nothing but the best

I feel bad for the kid. No good has come out of this. But this is the street life. The "end up in jail or dead" ain't no joke.

Its plain wrong to shoot someone in the back while they runnen... Scared of a 2nd gun or not is a lame excuse and just shows poor judgment by that police officer

East Oakland aint nothen sweet though, and 15 year olds can be killers too
